And based on the filing of their Intent to lien w= ith their North Dakota lawyers. By doing so, it appeared that they did not = want to keep any settlement quiet and outside of public view. The fact tha= t the lien amount was for full value and did not take into consideration th= e proffered down payment, also was unsettling. Yes, the Board has rejected the ENGlobal’s&nbs= p; counter offer which added the additional two conditions. And based on th= e filing of their Intent to lien with their North Dakota lawyers. By doing = so, it appeared that they did not want to keep any settlement quiet and outside of public view.  The fact that the l= ien amount was for full value and did not take into consideration the proff= ered down payment, also was unsettling.  Why they decided that a Confe= ssion of Judgment was not satisfactory, and had to go to the extent of the construction lien process, added to the mis= trust festering between the parties.   Nonetheless, there is no c= lear offer currently extended nor accepted by the parties.

The Board was of the collective opinion that ENGloba= l was not sincere in its attempts to settle this matter.  Especially w= hen they kept changing the amounts being paid down, the terms thereafter, a= nd most importantly when they notified AIC on February 24th of their intent to file its Construction l= ien, and then added the terms not to contest the lien for the full amount o= f their lien, as a term of settlement.

They actually just rewewed their final demand, which was $2,750,000 w= ith no remedies.  I’m guessing, from our conversation, that they= would accept a reasonable payment  plan.  But, no right to cure because they claim that they are owed approximately $4.0 mil= lion so the discounted settlement amount is to settle completely.

EnGlobal will not come off its $2.75 million “final” off= er.  I’m not convinced that they won’t agree to a  pa= yment plan with a Confession of Judgment, but they won’t come off the= ultimate number.
